Booking Deposits & Cancellations 

A $500.00 booking deposit which is due at the time of the reservation. The full rental amount is due no later than 30 days before the arrival date of the reservation. Renters who cancel their reservations more than 31 days before the arrival date will receive a full refund less a cancellation fee of $100.00.  

 

Cancellations requests received 30 days or less prior to their arrival date will result in the loss of the full rental amount. The booking deposit will be credited to the total rental amount unless the renter agrees to post a $500 refundable security deposit (“RSD”). In lieu of a RSD or the purchase of security deposit insurance (“SDI”) or if an SDI claim is denied because of Renter’s failure to comply with SDI policy terms, Renter authorizes PABHC to hold a valid credit card on file for 60 days and further authorizes PABHC to charge the card for any damages for which the renter is responsible for during the term of the rental. 

 

If the SDI does not cover all of the damage, Renter authorizes PABHC to charge Renter’s credit card for the deficiency. The holding of a credit card and the authorization to charge it is referred to in this agreement as a “security deposit.” The RSD, if any, will be returned in full within 10 days after the conclusion of the rental, less any amounts subtracted for damage.

PABHC Rules

  • Renter of property must be 25 years of age or older.   
  • PABHC does not allow rentals for Fraternity, Sorority, Bachelor or Bachelorette Parties.  
  • Representatives from PABHC have the right to enter the rented properties at any time, with or without the Guest’s consent, to inspect the property or to perform any routine maintenance. Refusal to grant entrance may result in eviction. 
  • Our properties have occupancy limits and they are listed in the homes description on our web site. These limits include adults and children. If you have more than the allowed occupancy limits staying in the rental property, without the express written consent of PABHC, you may be evicted and if so will surrender any security deposit and the full rental amount. 
  • All reservations are subject to cancellation at the sole discretion of PABHC at any time prior to the commitment of the rental. Should PABHC cancel your reservation at its discretion, all deposits and pre-paid amounts will be refunded to the renter without penalty.  

Renter agrees to abide by the following rules

  • While renter may rinse cars or boats with the hose, renter agrees not to wash vehicles in the driveway 
  • No glass containers permitted in any pool areas 
  • No smoking in any of the rental homes or leaving of cigarette buts in the yard or on the property 
  • No parking in the grass or vacant lots 
  • Porch furniture may not be taken to the beach 
  • Renter agrees to rinse sand and debris with the outdoor shower or hose before entering the house if returning from the beach 
  • Renter agrees not to rearrange the furniture in the house 
  • Renter agrees not to move the barbeque grill to a second or third level and further agrees not to use it on a wooden surface, like a deck 
  • Do not turn off, re-program, or disable any irrigation system 
  • All trash must be removed from the house at check out and trash must be placed in the garbage cans

Violation of these rules may result in charges, to be determined in the discretion of PABHC, against the security deposit. In addition to the community rules, Renter also understands and acknowledges that complaints to the police or by other renters or owners about lewd or in appropriate behavior, noise, public nudity, fighting, drug use, etc. will result in forfeiture of the deposit and full rental amount and may, in the sole discretion of PABHC, result in eviction. 

 

Renter also understands and acknowledges that damage to the house, such as broken furniture, windows, doors, fixtures, and the like, in the sole discretion of PABHC, may result in eviction and forfeiture of the full rental amount. 

Pet Policy 

Not all properties allow pets. Pets are permitted at pet- friendly properties ONLY. A non-refundable cleaning fee for pets will be due at the time of booking. Prior to rental, renter must provide PABH with the number and type of pets that will be on property. 

 

  • Pet owners must pick up their pet's waste.  
  • Pets found or seen in pet friendly homes without notice to PABHC and payment of pet cleaning fee will result in the fee being assed from a security deposit or credit card.  
  • Pets found or seen in non-pet-friendly homes will result in the renter forfeiting the entire security deposit and may result in eviction. 

Cleaning Procedures 

  • Advanced cleaning protocols to follow Airbnb and VEBO guidelines 
  • All linens are sanitized and washed in a commercial laundry facility 
  • All surfaces are disinfected 
  • All housekeepers wear masks and gloves while cleaning 

Check In Procedures 

  • Check-in time is 4 pm on the first day of the reservation 
  • Contactless check in now available 

Check Out Procedures 

Check out time is 11:00 am on the last day of the reservation. Renter understands that an early morning check out is necessary to allow time to prepare for other incoming renters. Holding over past 11:00 am without express permission of the PABHC will result in a $100 per hour charge against the Deposit for every hour or fraction of an hour Renter stays past noon. 

 

Renter agrees to leave property in the substantially the same condition as upon check-in, namely: 

 

  • All dishes put away 
  • Grill put away 
  • Furniture in same locations 
  • All lights off 
  • All trash removed and placed in garbage cans, etc.  

Renter understands that if a cleaning fee is charged or included in the rental, additional charges will be assessed for infractions of this paragraph or failure to follow check-out procedures. Fees for violations of this paragraph are charged at a minimum rate of $25.00 per hour. 

Renter Responsibility 

Renter agrees to accept responsibility for all damage caused by Renter or Renter’s guests to the property. This includes replacement cost for any broken or missing items of property, any costs of repair, and cleaning fees if the property is left in an uncleanly condition. 

Liability

Unless caused by PABHC, PABHC is not responsible for personal injuries or property damages caused to Renter or Renter’s guests or their property by Renter, Renter’s guests, or third parties. PABHC is not responsible for injuries to Renter or Renter’s guests or their property for unforeseeable or dangerous use of the property. Renter agrees to indemnify PABHC and hold it harmless in the event of legal action against owners arising from Renter’s use of the property for injuries that occur on the property that are not the fault of PABHC. 

 

PABHC is not responsible for Renter’s or Renter’s guest’s personal property. 

Returned Deposit Checks 

Returned Deposit checks will result in a $50 charge and potential forfeiture of the reservation. 

Hurricane Season 

Renter understands that the weather in a coastal environment from May through November can be volatile and subject to the risk of hurricane. No refunds will be given for hurricane-related interruptions within 30 days of the reservation or after the rental period has started; renter will be responsible for the entire rental amount and no refunds will be given. For this reason, Renter is encouraged to purchase travel insurance. 

SDI/Depreciated Value/Responsibility

If you purchase SDI and cause covered damage during your rental, SDI may pay only “depreciated value” for a damaged piece of property. If the damaged property cannot be replaced for the “depreciated value” offered by the SDI carrier, Renter agrees to pay the difference between the depreciated value and the replacement cost for a like or similar piece of property. These costs will be treated as damage under the security deposit terms. If Renter causes damage and the SDI carrier denies the claim or fails to pay within a reasonable period of time not to exceed 60 days, Renter agrees to assume responsibility for the damage and authorizes PABHC to charge the credit card Renter used to secure the reservation for the amount of the damage per the security deposit terms of paragraph  

Additional Information 

  • If PABHC charges the Renter’s credit card under this paragraph, PABHC agrees to pay renter, upon receipt from the SDI carrier, any sums received from filing the claim. Renter assumes full responsibility for satisfying any preconditions for coverage required by the SDI carrier and acknowledges it is not relying on PABHC for this information. If a claim is denied by the SDI carrier for Renter’s failure to satisfy preconditions required by the SDI carrier, Renter agrees to be responsible for all damages caused by Renter under the security deposit terms in paragraph 2. 
  • This document constitutes the entire agreement between the parties. It will be construed under the laws of the State of Texas. Venue for any dispute arising out of this agreement or the rental period will lie exclusively in Nueces County, Texas. Should legal action by PABH or owners become necessary to enforce this agreement or for any dispute arising under this agreement, Renter agrees to pay all legal fees incurred by PABHC, including costs and expenses.
