Port A Beach House Company Terms & Conditions
Welcome to the Port A Beach House family! We’re excited to host you. Please read this vacation rental agreement carefully before your stay.
Any monies received by Port A Beach House Company (PABHC) for occupancy of a vacation property indicate your acceptance of these terms in full. All policies are strictly enforced. It is the responsibility of the guest and all members of their party to be familiar with all policies relating to the rental.
1. Renter Requirements
The person placing the reservation must be the same person as the credit or debit card holder.
Renter must be 25 years of age or older.
A copy of a valid ID must be emailed prior to check-in. Check-in instructions will not be released until this is received.
PABHC does not allow rentals for fraternity, sorority, bachelor, or bachelorette parties.
The person who books the reservation is considered the Guest of Record. All other guests are considered invitees of the Guest of Record. All discussion regarding the reservation, charges, cancellations, and damages will be with the Guest of Record only.
2. Payments & Down Payment
A 25% down payment of the total rental amount is required to secure the booking.
Final payment is due 30 days prior to check-in.
Reservations made within 30 days of arrival must be paid in full at the time of booking.
Port A Beach House Company will automatically charge the card on file when payment is due.
Cash is not accepted.
3. Damage Policy
PABHC reserves the right to charge the Guest’s credit card for any guest- or invitee-caused losses or damages to the property during the stay. This includes excessive cleaning, eviction-related costs, service calls or charges, fines or assessments, repairs, replacements, and applicable taxes.
By written or electronic acceptance of this agreement, Guest agrees to pay for all such charges.
Guests agree to accept full responsibility for damage caused by themselves or their guests, pay replacement cost for broken or missing property, pay for cleaning beyond normal turnover if the property is left excessively dirty, and pay attorney’s fees incurred by PABHC or the Owner while collecting damages.
4. Emergencies & Maintenance
If you have issues accessing the property or problems with the functionality or condition of the property, contact the Port A Beach House Company office at (361) 749-0027. Our answering service is available 24/7.
If issues arise after hours, we will make every effort to return your call promptly. All concerns must be reported during the stay so we have an opportunity to address them.
5. Arrival (Check-In)
Standard check-in time is 4:00 PM. Early check-in may be available for a $50 fee and must be arranged in advance. Early check-in is dependent on housekeeping and scheduling and is not guaranteed.
Unless previously approved, please do not arrive before your scheduled check-in time.
6. Departure (Check-Out)
Check-out time is 11:00 AM sharp.
Late check-out may be available for a $50 fee and must be pre-approved. If you leave after 11:00 AM without approval, you may be charged a fee per hour past 11:00 AM (minimum one hour). If the property has not been vacated by 11:30 AM, you may be charged up to one full day’s rent.
Before departure, guests must wash and put away dishes, clean and put away the grill if used, return furniture to original positions, turn off all lights, and remove all trash to designated outdoor containers. Additional cleaning fees may be charged for failure to follow these procedures.
7. Refunds
No refunds or rate adjustments will be issued unless we are notified during your stay and given an opportunity to address concerns.
Once you have checked in, no refunds are given for early departure.
If you do not cancel and do not arrive, all monies paid are forfeited.
No refund or adjustment will be made for failures of electricity, water, pool filtration systems, A/C or heating, telephone, cable, internet, appliances, or golf carts.
8. Cancellations
Cancellations more than 31 days before arrival will receive a full refund minus a $100 cancellation fee.
Cancellations 30 days or less before arrival receive no refund.
No refunds are issued for acts of nature such as weather, storms, road conditions, or power outages. Travel insurance is strongly recommended.
Hurricane-related interruptions within 30 days of arrival or after the rental begins are not eligible for refunds. The renter remains responsible for the full rental amount.
9. Property Condition
PABHC is a rental agency acting on behalf of property owners. Properties are advertised to the best of our ability. PABHC is not responsible for latent defects, environmental conditions, injuries, accidents, theft, or damages to guests or invitees.
Some areas of the property may be locked for Owner use only. Tampering with Owner-locked areas may result in forfeiture of the security deposit and additional fees.
10. Number of Guests / Occupancy
The number of guests may not exceed the number listed on the reservation.
Unauthorized guests may result in extra charges, cleaning fees, damage charges, or possible eviction.
These homes are not intended for large parties or events unless approved in writing.
If police are called to the property due to excessive noise, illegal activity, or policy violations, guests may be evicted without refund and additional charges may apply.
11. Repairs & Construction
Equipment can malfunction unexpectedly. Repairs will be addressed as soon as reasonably possible.
PABHC staff and authorized vendors may enter the property during business hours to perform inspections, maintenance, or repairs.
No refunds will be issued for malfunctioning equipment, nearby construction noise, or dissatisfaction with property condition.
12. TV / Cable / Internet / Satellite
These services are provided as conveniences and are not guaranteed. No refunds will be issued for outages, limited access, or connectivity issues.
13. Air Conditioning & Heating
If the property is equipped with HVAC:
A/C should not be set below 72°F.
Heat should not be set above 78°F.
Fan should remain on “Auto.”
Doors and windows must remain closed while heating or cooling is in use.
No refunds will be issued for lack of or malfunctioning HVAC systems.
14. Golf Carts
Guests must email a copy of auto insurance and a driver’s license to the golf cart company for homes with cart included.
15. Swimming Pool Usage
Guests use the pool and surrounding areas at their own risk. PABHC and Owners are not responsible for accidents or injuries.
Pool or spa heat may require an additional fee and must be paid in advance. Guests may not tamper with pool equipment. Pool heat may not exceed 90°F. Surrounding areas may not be fenced or secured. There is a fee of $100 per day to each private pool and spas.
16. Smoking & Linens
Smoking is not permitted inside any PABHC property. A $500 cleaning fee will be charged if smoking occurs indoors.
Oil lamps and incense are prohibited due to persistent odors.
Towels, sheets, pillows, and blankets must remain indoors.
17. Pets
Pets are only permitted at designated pet-friendly properties. A $150 non-refundable cleaning fee per pet applies and must be paid at booking.
Guests must disclose the number and type of pets before arrival. Proof is required for registered service animals.
Pet owners must clean up pet waste.
If pets are discovered at a pet-friendly home without payment, the pet fee will be charged. If pets are found at a non-pet-friendly home, the guest forfeits the entire security deposit and may be evicted.
18. Right of Entry
PABHC may enter the property at any time to investigate disturbances, check occupancy, inspect for damage, or perform repairs.
Refusal to grant entry may result in eviction without refund.
19. Security & Safety
All doors and windows must be locked when leaving the property. Guests are responsible for personal belongings. PABHC is not responsible for theft or personal injury resulting from failure to secure the property. Children must be supervised at all times.
20. Lost or Left Items
PABHC is not responsible for lost or abandoned items. Items found will be returned if possible. A $50 handling fee plus shipping applies. Items unclaimed after 30 days may be discarded or donated.
21. Indemnification & Hold Harmless
Guests and invitees use the property and all amenities at their own risk. Guest agrees to indemnify and hold PABHC and the property owner harmless from claims, losses, or liabilities arising from use of the property, including injuries or allergic reactions.
22. Attorney’s Fees, Venue & Law
Texas law governs this agreement. Venue for disputes is Nueces County, Texas.
Guest agrees to pay attorney’s fees incurred by PABHC or Owners in collecting amounts due.
23. Mediation, Arbitration & Waiver of Class Action
Except for small collection suits in Justice Court (under $10,000), all claims are subject to written notice, mediation in Nueces County, and if unresolved, binding arbitration.
The non-prevailing party must pay the prevailing party’s attorney’s fees, litigation expenses, expert witness fees, and arbitrator fees.
By accepting this agreement, Guest waives the right to a jury trial and waives the right to participate in any class or collective action against PABHC.
